RECOVERY OF PREMISES: AN ASSESSMENT OF LANDLORD/TENANT LAW IN NIGERIA (1)

Every day with the increase in population, there is a concurrent need for houses to accommodate this rising population. As a result, there has always been the need for individuals, corporations and governments to build and lease or rent houses to fill this void. 

These houses could either be for residential or commercial purposes. This has brought the need to regulate the relationship between landlords and tenants so as to avoid arbitrary increments in rents, wrongful eviction and illegal holding over of premises. The procedure for recovery of premises is largely regulated by statutes. 
Accordingly, a landlord who seeks to recover his premises from a tenant must strictly comply with the provisions of these statutes. In other words, the slightest deviation from the requirements of the law will frustrate an attempt to recover possession of premises no matter how troublesome and terrible such a tenant may be.
Every State in Nigeria now has its own law on recovery of premises. Some of these laws include:
·         Recovery of Premises Act. Cap 544 Laws of the Federation of Nigeria (Abuja) 1990
·         Rent Control & Recovery of Residential Premises Law, Vol. 7, Laws of Lagos State, 2003
·         Lagos Tenancy Law, 2011
Section 2, Recovery of Premises Act Cap 544 Laws of the Federation of Nigeria (Abuja) 1990 states that a landlord is a person entitled to immediate reversion of the premises and includes the attorney or agent of any such landlord or any person receiving (whether in his own right or as an attorney or agent) any rent from any person for the occupation of any accommodation in respect of which he claims a right to receive same. 
This section further states that a tenant includes any person occupying premises, whether on payment of rent or otherwise, but does not include a person occupying premises under a bona fide claim to be the owner of the premises. The Rent Control and Recovery of Residential Premises Law, Vol. 7, Laws of Lagos State of Nigeria 2003 expressly include a sub-tenant and service tenants (homes occupied by virtue of employment) for the purpose of recovery of premises.
The Recovery of Premises Laws have been enacted in various States principally to provide for procedures a landlord must adopt to recover possession. Such procedures are primarily to protect the interest of the tenant against that of the landlord. Coussey, J.C.A. observed in the case of Okedare v. Hamid (1955) 15 WACA 17 at 19, that:
“The main object of the Recovery of Premises Law was to place limitations on the common law rights of a landlord with the object of regulating the recovery of and restraining summary eviction from occupied premises.”
At common law, the landlord on the effluxion of time or expiration of a valid notice to quit, may proceed to court for possession. However, the Recovery of Premises Laws requires an additional 7 days notice of owner’s intention to apply to court to recover possession to be given to the tenant. The landlord can only take out a writ after the expiration of the 7 days. The tenant therefore becomes a statutory tenant and cannot be evicted by force, but by a lawful court order.
For unlawful eviction, the landlord can be sued and made liable for damages. In Ihenacho .v. Uzochukwu (1997) 1 SCNJ 117 at 284, the Supreme Court of Nigeria held that resort to self-help by the landlord to evict a tenant who is in lawful occupation is not within the purview of the provisions of the Recovery of Premises Law and that such a landlord renders himself liable to the tenant in trespass. But at common law, the tenant does not have that right; he is treated as a tenant at sufferance or a trespasser.
Procedure for Recovery of Premises
Before the procedure laid down in the Recovery of Premises Laws can be invoked, two factual conditions must be satisfied:
·         There must be in existence some “premises” as defined by law. Section 36 of the Rent Control and Recovery of Residential Premises Law of Lagos State, 2003 defines premises to include, “a house or building or any part thereof together with its gardens or other appurtenances”
·         The landlord-tenant relationship must be established. However, in Ihenacho’s case, it was held that the landlord must still comply with the procedure laid down in the law even if there is no landlord-tenant relationship; provided the person sought to be evicted is in lawful occupation.

Living Your Space: The Bedroom

 The Bedroom. This word conjures up a picture of a room and a bed. People with very fertile imagination will go a step further to imagine someone sleeping peacefully on a bed after a hard day’s work or maybe two people getting down to some serious quality time together. Whichever way you may choose to look at it, a bedroom is a room with a bed (of course), and also is part of an apartment. It is a place where you let your hair down and generally relax and chill out after the hustle of the day.

A Simple Bedroom!
Growing up as a child those days, I sometimes imagined what took place in my parents’ bedroom. Mum when she was angry and some times out of control always felt better when she and dad went in to the bedroom and after a few hours mum comes out wearing this huge smile on her face. I grew up with this feeling that all problems between adults were settled with a trip into the bedroom. Yeah! Well not until I became an adult myself and realized that a different kind of ‘war’ also was fought and won in the bedroom as well.

Before writing this piece, I had taken the liberty to do a survey of what people felt about the bedroom. I sent inbox messages to some friends on my list to find out what their ideal bedroom space is like. You will be amazed at the responses I got.. The ladies wanted a good night’s sleep after the day’s chores of running a home and doing school run, a small portion of the ladies wanted quality time with their man (I later found out that these category were either in a serious relationship or just recently married) hmmmm.

The men on being asked what their ideal bedroom space is like immediately said “Liz do not start what you cannot finish o”.  Hey guys no one is starting anything here, I merely asked a simple question which deserved a simple answer! Some of the men will make do with a good mattress on the floor and something on the window, also a chair and a table, a television and radio. A few were particular about color scheme, but they all agreed that a bedroom is for sleeping and doing every other thing in between.

For me a bedroom should reflect the kind of person you are. I remember visiting a friend those days in Festac where I grew up. She took me up to her room which she shared with her mum. It was lunch time and she wanted to offer me something to eat. Before I could say “sweet dreams” my friend reached underneath the bed we were sitting on and pulled out a steaming pot of stew!  My hunger disappeared immediately; I looked at her with a puzzled look on my face I wanted to say something but kept my mouth shut.

As mentioned earlier the bedroom is a reflection of the kind of person you are just like your whole apartment and décor also reflects your taste and your personality.
My bedroom is not as big as a football field, but the space is just right for me. I decorated a couple of years back. I wanted a cool pink color on my wall which was to be done in two tones; unfortunately my painter had his own idea which left me with a funny pink wall. I had to get window curtains in brown to do some damage control. Coming home every night for me is cool, I love my bedroom the way it is.

A bedroom should be spacious with very good ventilation. That is one thing I enjoy in my room. The wall should be painted in cool calming colors that are soothing. Colors like a very soft blue, something green, a pale pink, off white, or you could have two shades of colors the options are endless.
It is important to have window curtains that will stand out from the colors on the wall. I love lacy curtains it is famine and romantic. These days there is a wide range of curtains to choose from.

You could also choose to have the floor tiled with an area rug either at the foot of the bed or at both sides of the bed. The bed frame and mattress depends on your preference. Some people would rather have one of those really huge mattresses on the floor and not bother with a bed frame while others will not be caught dead sleeping on a mattress without a bed frame. The choice of a bed sheet and duvet is also relative. People most times do not have time for frivolities; just a mattress on the floor and a sheet over it is cool.
I like a well made bed. Nothing beats that, though most times with the hectic schedule one has to keep up with, am dead to the world before my head even touches the pillow.

The bedroom is never complete without a dressing table. Most times the dressing table comes as a set with the bed frame. It is important to place the dressing table in such a way as to allow the natural light from outside fall on your face while applying your make up.

It is common these days to find a television set complete with DVD in the bedroom. It is also important to have clothes and shoes properly stored and not strewn all over the room. A friend shared her experience with me. She noticed a smell coming from underneath her boyfriend’s bed and decided to investigate, on looking underneath the bed one day with a flash light; she saw a small pile of used boxer shorts! Apparently her man who loved sleeping nude always took off his boxers while in bed and sort of throws it on the floor where it found its way underneath the bed aided by the fan!

We go through our daily life each day with lots of stress, a good part of the day is spent in traffic. Nothing beats coming home to a well apportioned bedroom space. We may not all have state of the art bedrooms, that does not mean that we should not enjoy whatever space we have for a bedroom. New Name, Same Content: Realty Magazine Becomes Property Max

Incoming: The New Edition of Property Max
The recently launched real estate publication-Realty Magazine- has changed its name to Property Max. The change will take effect from the next edition of the publication set to be in circulation by Monday, 19 August, 2013.
According to the Editor of the publication Mr. Olumide Agunbiade, the change in name does not affect the content of the publication- "Yes there has been a change in name of the publication but the idea of the publication does not change. I would say it is New Name, Same Content. We would like to inform the public that the site realtymag.blogspot.com will now become propertymaxng.blogspot.com".
Outgoing: Realty Magazine will be replaced with Property Max
When pressed further as to what could make the company change the name of the publication, he declined to state categorically the reasons saying that for now, it remains exclusive to top management staff of the organization but in due course, the public will be brought up to speed.

THE 6TH FLOOR: FANNING THE FLAME (1)

I was busy checking my mail on my laptop at about 10am on that day when he entered my office on the sixth floor of a 10 storey building at Ikeja and settled his bulk on a couch beside me.
He looked every inch a comfortable man. He was around 65 years old and had a belly on him that could have been mistaken in the dark for a pregnancy. He was tall dark and shy handsome, he wore a buba and sokoto a white cap and a white pair of shoes that shone even in the office.
Once he had settled himself, taken a quick look around, he turned his attention to me. I turned off my radio set as he said: “Hello! I’m Akande Raymond.’’
I was aware that is small dark eyes were staring at my clean shirt and trouser that had cost five thousand naira three months ago. His small dark eyes also took in the wristwatch in my hand and the cash beside my laptop.
                              “You are welcome Sir!’’ I replied.
 He puffed out his fat cheeks, took off his cap, wiped his forehead, put on the cap, and then said in a mild voice: “I need a 2bedroom flat of 200,000 per annum that I can pay for right away!”
I was beginning to wonder if this man was from another planet or maybe he just arrived in Lagos. I was in no mood for jokes and looking at this man closely, I was sure he was not joking at all.
                             “Which area do you prefer Sir?” I asked.
                              “I prefer Ikeja here,” he replied.
                            “The ones available are between N500, 000 and N2million per annum Sir! I replied quietly.
                            “Are you serious?” he asked.
                             “Yes Sir.”
                              “How much is a 3bedroom flat then?” he asked.
                              “Between N800, 00 and N4million per annum.”
I was wondering why he was asking me such questions but the shock in his small dark eyes was genuine. He was staring at me and when I looked away, he bowed down his head and shook it quietly. He soon raised it up again, puffed out is fat cheeks, took off his cap, wiped his forehead again and then put on his cap.
In a very quiet but sad voice he said: “How much is a plot of land at Akoka?”
